Nocturne Games SAS is a French independent mobile studio. We develop mobile applications and web services for iOS. Our services include mobile applications, web platforms, and digital tools. Nocturne Games SAS is registered at 38 RUE DE BERRI, 75008 PARIS.
Subject to your compliance with these terms, Nocturne Games grants you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use our mobile applications on your personal devices; make backup copies of the applications for your own use; and use the applications solely for personal, non-commercial purposes.
You agree to use our services only for lawful purposes and in accordance with these terms. You may not use our services in any way that violates applicable laws; transmit or distribute illegal, harmful, threatening, abusive, or defamatory content; attempt to circumvent security measures; use our services to harass, abuse, or harm other users; collect or store personal information of other users without their consent; or use our services for commercial purposes without written authorization.
You may not copy, modify, adapt, or create derivative works of our applications; reverse engineer, decompile, or disassemble our applications; distribute, rent, lease, or sublicense our applications; use our applications for illegal or unauthorized purposes; bypass or disable security features; or extract data from our applications to create competing products.
All intellectual property rights in our services, including software, designs, text, graphics, logos, and trademarks, are the exclusive property of Nocturne Games SAS or its licensors. Our applications and all their components remain our exclusive property.
You retain ownership of any content you submit or transmit through our services. By submitting content, you grant us a non-exclusive, royalty-free license to use, modify, and distribute such content in connection with our services.
Nocturne Games reserves the right to modify or update our applications at any time, add or remove features, modify these terms with notice, and suspend or discontinue access to our services.
Use of our applications may involve the collection and processing of personal data in accordance with our Privacy Policy. By using our applications, you consent to such collection and processing.
We strive to maintain the availability of our services, but we do not guarantee that they will be available at all times. We reserve the right to modify, suspend, or discontinue our services at any time, with or without notice.
OUR APPLICATIONS AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. NOCTURNE GAMES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOCTURNE GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.
These terms are governed by the laws of France. Any disputes will be resolved in the competent courts of France.
We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the updated terms.
